Acceptance of These Terms

By accepting these Terms & Conditions, you provide HappyPics Photography ("HappyPics", "we", "our", or "us") with permission to photograph your child(ren) during photography sessions organised through their childcare centre, kindergarten, preschool or school. This may include individual portraits, sibling photographs (where applicable), and class or group photographs.

By proceeding with your booking or placing an order, you acknowledge that you have read, understood and agree to these Terms & Conditions and our Privacy Policy.

Privacy Policy

HappyPics Photography is committed to protecting your privacy and handling your personal information responsibly. This Privacy Policy explains how we collect, use, store and disclose personal information, including photographic images.

Collection of Personal Information

We collect personal information that is reasonably necessary to provide our photography services.

The information we may collect includes:

• Parent or guardian name
• Postal address
• Email address
• Telephone number
• Child's name
• Child's class, room or group
• Photographic images of your child

We collect this information directly from you and, where necessary, from your child's childcare centre, kindergarten, preschool or school.

Personal information will only be retained for as long as required to provide our services or to meet legal obligations. When no longer required, information will be securely deleted or destroyed.

Use of Personal Information

Your personal information is used to:

• Provide photography services
• Process and fulfil orders
• Deliver photographs and digital products
• Provide customer support
• Manage administration and record keeping
• Communicate with you regarding your order or future photography events

We will only use your personal information for the purpose for which it was collected, or for directly related purposes that you would reasonably expect.

Disclosure of Personal Information

HappyPics Photography will not sell your personal information.

We may disclose your information where:

• required to investigate suspected unlawful activity;
• requested by authorised law enforcement agencies; or
• necessary to prevent a serious threat to a person's life, health or safety.

We may also disclose information to trusted service providers who assist us in delivering our services, including payment processing and website hosting. These providers are required to protect your information in accordance with applicable privacy laws.

Image Privacy and Media Consent

HappyPics Photography respects the privacy of every family.

We will not use photographs of your child for advertising, marketing, social media, websites or other public promotional purposes without prior written consent from a parent or legal guardian.

Media consent is only valid where a signed and dated HappyPics Media Release has been received.

Images taken during photography sessions may be securely uploaded to our private online ordering platform solely for the purpose of allowing authorised families to view and purchase photographs.

Direct Marketing

From time to time, we may send information about future photography events, products or promotions.

You may opt out of receiving marketing communications at any time by contacting HappyPics Photography. We will promptly remove you from future marketing communications.

Changes to this Privacy Policy

We reserve the right to amend this Privacy Policy at any time. Any updates will be published on our website and will take effect immediately upon publication.

Website, Systems and Security

Website Availability

While we endeavour to ensure our website remains available at all times, scheduled maintenance or unforeseen technical issues may occasionally result in temporary interruptions.

HappyPics Photography is not liable for any loss, inconvenience or damages arising from website interruptions, delays or temporary unavailability.

Data Backup

We maintain regular backups of website data for disaster recovery purposes.

Should restoration from backup become necessary, we will restore the most recent available backup. While every effort is made to ensure data integrity, HappyPics Photography cannot guarantee that restored data will always be complete or current.

Information Security

We implement commercially reasonable physical, technical and organisational security measures to protect personal information against unauthorised access, alteration, disclosure or destruction.

However, no internet transmission or electronic storage method is completely secure. Accordingly, while we take reasonable precautions, we cannot guarantee absolute security.

Users are responsible for maintaining appropriate security measures on their own devices when accessing our website.

HappyPics Photography accepts no liability for unauthorised access resulting from circumstances beyond our reasonable control.

Online Transactions

All purchases are processed through our secure online ordering platform:

Payments are processed securely using the Stripe payment gateway.

Happy Parent Guarantee

HappyPics Photography proudly offers our 100% Happy Parent Guarantee for families who prepay for a Photo Day Package.

Important: Once any digital image has been downloaded from your account, your order becomes ineligible for a refund.

The Guarantee Covers

You may be eligible for a reshoot or refund if:

• You receive fewer than four usable images of your child.
• The photographs are demonstrably below professional standards for exposure, sharpness or image quality.
• Your child was absent or unwell on Photo Day.
• Your child is visibly distressed or crying throughout the photography session.

The Guarantee Does Not Cover

The guarantee does not apply where:

• Your child chooses not to participate in a class or group photograph.
• Your child is not looking at the camera in a class photograph.
• You request different expressions, poses or cropping preferences.
• You would prefer greater pose variety.
• Sibling photographs contain similar poses.
• You knowingly booked despite being unavailable due to holidays or travel.

Reshoots and Refunds

Any request under the Happy Parent Guarantee must be submitted within 7 days of receiving your photographs.

If approved, HappyPics Photography may offer either:

• a complimentary reshoot at our Head Office; or
• a full refund where a reshoot cannot reasonably be arranged.

To receive a refund:

• the complete Photo Day package must be returned in good condition;
• original images will be removed from your online gallery; and
• images from the original session cannot be combined with photographs from the reshoot.

Portrait Sessions

Throughout the year, HappyPics Photography may offer portrait sessions outside childcare centres or schools, including sessions held in parks, reserves and other public locations.

Bookings are made through our online booking platform.

Portrait sessions:

• are prepaid;
• are limited to one booking per family unless otherwise agreed; and
• may occasionally be conducted as fundraising events.

If, for any reason, HappyPics Photography determines that a portrait session cannot proceed, a full refund will be issued. No further compensation or liability will apply.
